The purpose of these General Conditions of Sale (GTS is to define all the relations between the company So’Primeur and its clients)
So'Primeur reserves the right at any time to adapt or modify its terms and conditions. The terms and conditions the day of the order will be applied to each order. Therefore, the client is invited to visit the site regularly to keep informed.
The customer acknowledges, at the time of placing the order, the special conditions mentioned on the website (name, price, weight, quantity, color, …) and expressly accepts them without reservation. Placing the order and its confirmation by the customer, materializes its full acceptance of the special conditions of sale, only applicable to the order.
All ordering implies full and unconditional acceptance of the conditions.
The customer orders according to the instructions on the website. He selects among all the proposed products and add them to its basket by clicking on the “Add to cart” button. The photos on the website are not contractual and do not in any case represent the exact products that will be delivered. The words « organic product » or « AB » means product from organic agriculture certified by QUALISUD.
Before proceeding to the payment, the customer has to enter its phone number in order for So'Primeur to communicate by sms the delivery of his order. The customer is solely responsible in case of error on the phone number. So’Primeur cannot be held responsible.
The command is a subject of a summary that includes all the elements the customer has to confirm following the indicated steps. The order will actually be confirmed when the customer click on « I confirm my order » at the last step.
The minimum order is set at 5€ for any order. This amount is indicated excluding promotional code.
Sales are made at the price indicated on the website on the day of the order . The prices are in Euros and all taxes included.
The terms of payment are applied to any transaction between the seller and his customer.
The payment is done by credit card via the secure payment of the website, but also for any type pf payment proposed on this website.
The place of delivery must be part of the list of distribution points available on the website. This list will evolve over time. Otherwise the order cannot be validated by the customer. The deliveries will be done on days and times indicated on the website according to each distribution points functioning.
The customer who discovers when unpacking that one or more products are damaged or missing must imparatively warn So’Primeur who will proceed to a compensation by renewing the concerned products. If applicable, So’Primeur may reimburse these items but to the exclusion of all others compensation or damage and interest.
Claims concerning the delivered products must be, as fas as they are concerned, made with a time limit after the delivery of the product (24h)
In case of force majeure, if the product could not be delivered, the sale may then be cancelled and the buyer will obtain a refund of its settlement to the exclusion of any other compensation or damages.
Are considered as cases of force majeure discharging the seller of his obligation to deliver, war, riot, fire, stirkes, accidents, the impossibility of being supplied or delivered. The seller will keep the buyer informed in a timely manner of the above cases or events.
After the delivery, the buyer has 48h to get its products. Once time is expired, the products of his order will no longer be available, the customer will no longer have access to his order and will not be able to get a refund.
Complaints or disputes will always be received with attentive benevolence, good faith is always presumed in those who take the trouble to explain their situations.
For perishable foodstuffs, in case of hidden defect, or of a quality judged by the customer, the latter can get in touch by email or mail within 24h of receipt of the order, providing factual evidence of his dissatisfaction ( Order number, photos, description of the non conformity).

Otherwise, the French courts will have sole jurisdiction.
The so-primeur.fr website may contain hyperlinks to other websites, So'Primeur makes no commitment regarding any other site to which you may have access via soprimeur.fr and is in any way responsible of the content, functioning, proposed services and access to these sites governed by their own general conditions of sale.
So’Primeur declines all responsability in case of misuse of the products which it markets. The products are foods that in most cases must be prepared (washed, peeled, cooked, …) before being eaten.
Personal date collected on the costumer when registering are subject to the provisions of the IT law n°78-17 of 6 january 1978, on files and Freedoms. The Consumer therefore has the right to object provided for in Article 26 of that Law, the right of access provided for in Articles 34 to 38 of that Law and the right of rectification provided for in Article 36 of that Law. These rights of access and rectification may be exercised by email to the following address : firstname.lastname@example.org. So’Primeur does not communicate to third parties the personal data collected on the customer and and does not transfer them outside the European Economic Area.
These general conditions of sale are subject to French law.
Protection of minors
In accordance with article L. 3342-1 of the Public Health Code, which stipulates that the sale of alcohol to minors under the age of sixteen (16) is prohibited, the buyer agrees, by validating his order, to have completed sixteen (16) years of age on the date of the order by accepting the terms and conditions at the time of payment.
